Article 1 – General Provisions

These General Terms and Conditions of Sale apply exclusively to online sales offered on the website www.petitartichaut.com, operated by BTL Diffusion, a simplified joint-stock company (SAS) with capital of €100,000, registered with the RCS of Versailles under number 480 025 485, with its registered office at 14 Chemin des Vaux, 78490 Galluis, France.

These terms exclude any other conditions, including those applied in physical stores or on partner sites.

The website www.petitartichaut.com is intended solely for individual consumers wishing to purchase Petit Artichaut products for delivery within mainland France. Orders for delivery outside this zone will not be accepted through this site.

By checking the box “I have read and accept” when placing your order, you expressly accept these General Terms and Conditions of Sale.

BTL Diffusion reserves the right to amend these terms at any time without prior notice. However, the terms applicable to your order will be those in force on the date of its confirmation.

We recommend saving a copy on a durable medium (print or download).

 


 

Article 2 – Orders

2.1 Requirements

To place an order, you must have a valid email address and be reachable by phone. You may order via a customer account or as a guest.

To validate your order, follow these steps:

  • Add one or more available products to your cart,

  • Log in or proceed as a guest,

  • Choose a delivery method,

  • Enter or confirm billing and shipping information,

  • Review your order,

  • Read and accept the Terms and Conditions of Sale,

  • Choose a payment method and enter payment details,

  • Finalize by clicking "Pay".

2.2 Confirmation

Once validated, a web order number will be assigned, and you will receive an email confirming the essential elements of your order.

2.3 Availability

By placing an order, you offer to purchase the selected products. We strive to fulfill all orders. If an item is unavailable after confirmation, customer service will contact you promptly.

2.4 Commitment

A confirmed order is binding and cannot be canceled, except within your right of withdrawal (Article 6).

2.5 Product Images

Product visuals may vary slightly depending on screen settings. Such variations do not constitute non-conformity.

 


 

Article 3 – Prices

3.1 Currency and VAT

All prices are listed in euros (€), inclusive of VAT and any applicable eco-contribution.

3.2 Shipping Fees

Prices do not include shipping costs, which are shown on your invoice if applicable.

3.3 Validity

Prices are those in effect at the time of order confirmation. Price changes do not apply to already confirmed orders.

3.4 Cross-border Sales

Intra-EU purchases are not supported via www.petitartichaut.com.

 


 

Article 4 – Payment

4.1 Methods

Payments must be made in euros (€), via:

  • Bank card (Visa, MasterCard, American Express) through Shopify Payments

  • PayPal

4.2 Security

Payments are processed through secure platforms. BTL Diffusion never accesses or stores your banking information.

4.3 Authorization

For card payments, your issuing bank must authorize the transaction. Without authorization, the order will not be validated. Petit Artichaut may request identity verification.

 


 

Article 5 – Product Delivery

5.1 Delivery Area

Orders can only be delivered within mainland France.

5.2 Method and Timing

Standard delivery is via Colissimo (home or pickup point), with an indicative time of three (3) business days.

5.3 Delivery Address

Products will be delivered to the address entered on your order form. Separate orders must be placed for multiple delivery addresses.

In case of temporary unavailability, the order may be postponed. In case of delay, a new delivery date will be proposed by email.

If Petit Artichaut fails to deliver within the indicated timeframe (or within 30 days if none was provided), you may cancel your order and receive a full refund within 14 days of contract termination.

If the product is received after cancellation, reimbursement will be issued once the product is returned complete, in good condition, and in its original packaging, within 14 days.

5.4 Risk and Ownership

Ownership and risk transfer to you upon delivery.

5.5 Shipping Confirmation

An email confirmation will be sent if a valid email address was provided.

Petit Artichaut is not liable for delivery delays caused by customer unavailability. Please include all necessary delivery details (building number, floor, access codes, etc.).

 


 

Article 6 – Right of Withdrawal

6.1 Conditions

You have a legal right to withdraw within 14 calendar days from receipt. If the period ends on a weekend or public holiday, it extends to the next business day.

For multiple items delivered separately, the withdrawal period starts upon receipt of the last item.

Notify Petit Artichaut clearly of your withdrawal decision via the contact form. You will receive an acknowledgment by email.

Returned products must be in original condition, complete (packaging, accessories, manuals), and accompanied by the purchase invoice.

You have 14 days from your notice of withdrawal to return the item(s). See Article 8 for return instructions.

6.2 Effects

Upon valid withdrawal, Petit Artichaut will refund all payments including standard delivery costs (excluding express shipping) within 14 days of receiving the returned item(s).

Return shipping costs are your responsibility. Refunds will be made using the same payment method unless otherwise requested.

 


 

Article 7 – Legal Guarantees

7.1 Non-conforming or Defective Product

If you receive a faulty, incomplete, or incorrect product, contact customer service via the website form.

No transport fees apply if covered by a legal guarantee.

Legal Conformity Guarantee

Under French Consumer Code (Articles L.217-3 to L.217-20), you have a 2-year guarantee from the delivery date.

A product is considered conforming if it:

  • Matches its description and agreed qualities

  • Is suitable for typical use

  • Includes necessary accessories, instructions, and updates

  • Matches public statements by the seller or manufacturer

You may request repair or replacement (Article L.217-8), free of charge (L.217-11), within 30 days (L.217-10). Failing that, you may seek a price reduction or full refund (L.217-14).

Any defect appearing within 24 months is presumed to have existed at delivery (L.217-7). Time spent repairing the product suspends the guarantee period (L.217-12). Claims must be made within 2 years (L.217-13).

This guarantee is independent of any commercial warranty (L.217-16).

Hidden Defects Guarantee

Under Civil Code (Articles 1641–1649), you also have protection against hidden defects.

A hidden defect is one that:

  • Was not apparent at purchase

  • Renders the product unusable for its intended use

  • Or significantly reduces its usefulness

You may either return the product for a full refund or keep it and receive a partial refund (Article 1644). Action must be taken within 2 years of discovering the defect (Article 1648).

If confirmed by expert review, related costs may be reimbursed.

Petit Artichaut Commercial Warranty

During the first 2 years, your product is covered without registration.

Covers electronic or mechanical issues under normal use.

Excludes:

  • Consumables (nipples, batteries, fabric parts)

  • Damage from misuse, impact, or lack of maintenance

  • Normal wear and tear (e.g., fabric wear, discoloration)

  • Loss or theft

If the product is unavailable, a comparable item may be offered. No refunds apply under the commercial warranty.

A physical inspection may be required to process your request.

 


 

Article 8 – Product Return Procedures

8.1 Returns under Withdrawal

To return a product under the right of withdrawal:

  • Contact customer service via the site’s contact form

  • Include the provided return label in the package

  • Choose your preferred carrier (return cost is your responsibility)

  • Ship the product in proper packaging, with all accessories and documents, in good condition

Refunds will be issued within 14 days of receipt.

8.2 Returns of Defective or Non-conforming Products

To return a defective or incorrect item:

  • Contact customer service with details and photos

  • Wait for approval

Once accepted:

  • Petit Artichaut may arrange carrier pickup

  • Return labels will be provided

  • You’ll coordinate pickup with the carrier

Before sending, ensure:

  • Return label is attached

  • All accessories and documents are included

  • The product is in original packaging

  • The package is secure and protected

Returns must follow this procedure to ensure processing. Petit Artichaut will cover all related return costs (Article L.217-11).

 


 

Article 9 – Liability of Petit Artichaut

9.1 Scope

These terms define Petit Artichaut’s responsibilities related to product supply, delivery, after-sales service, and warranties.

9.2 Limitations

Only the guarantees described in Article 7 apply, unless otherwise legally required.

9.3 Exclusions

Unless required by law, Petit Artichaut excludes all implied warranties, including:

  • Merchantability

  • Fitness for a specific purpose

  • Compliance with standards not explicitly stated

9.4 Exceptions

These exclusions do not apply in cases of:

  • Death or injury due to negligence

  • Fraud

  • Breach of mandatory legal guarantees

  • Any case where liability cannot be limited by law

9.5 Limitations

Subject to Article 9.4, Petit Artichaut is not liable for loss of income, profit, contracts, data, or indirect/consequential damages. For business purchases, liability is capped at the amount paid.

9.6 Consumer Rights

Nothing in these terms limits your legal consumer rights under French law.

Article 11 – Export Control

11.1 Legal Compliance

You acknowledge that Petit Artichaut’s transactions may be subject to export control laws (UN, EU, US). Any such activity is governed by applicable export regulations.

11.2 User Obligation

You agree to comply with all applicable export restrictions. You accept responsibility for ensuring compliance by any third party receiving exported products. You will indemnify Petit Artichaut for any breach.

 


 

Article 12 – Personal Data

By ordering, you consent to Petit Artichaut processing your personal data for order fulfillment, customer service, and marketing if applicable.

You may access, correct, delete, or transfer your data or restrict/oppose its processing at any time.

 


 

Article 13 – Disposal of Electrical and Electronic Equipment

In accordance with EU Directive 2012/19/EU and French regulations, electrical and electronic waste must not be disposed of with household waste.

All Petit Artichaut products with power sources must be recycled through specialized channels. Products bear the "crossed-out bin" symbol, indicating selective collection is mandatory.

Dispose of such items at a waste collection center or approved drop-off point.

 


 

Article 14 – Force Majeure

Petit Artichaut shall not be liable for failure or delay due to force majeure (as defined in Article 1218 of the Civil Code), including but not limited to: natural disasters, fire, floods, war, terrorism, epidemics, strikes, supply chain issues, or infrastructure failure.

If the disruption lasts over 30 days, either party may cancel the order without compensation.

 


 

Article 15 – General Provisions

15.1 Severability

If any provision is held invalid, the remaining provisions remain in force.

15.2 No Waiver

Failure to enforce a provision does not waive the right to enforce it later.

 


 

Article 16 – Mediation and Jurisdiction

16.1 Initial Contact

In the event of a complaint or dispute, contact Petit Artichaut’s customer service first to seek an amicable resolution.

16.2 Mediation

Per Articles L.612-1 and following of the Consumer Code, you may access free mediation via:

16.4 Jurisdiction

If no amicable resolution is reached, French law applies. Jurisdiction lies with the courts as defined by the French Code of Civil Procedure for consumers.
